Dealers MUST have a valid Retail Sales Tax License. WorldFlyAngler is NOT open to the public and does not sell to the public.

This website is operated by WorldFlyAngler. Throughout the site, the terms “we”, “us” and “our” refer to WorldFlyAngler. WorldFlyAngler offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions, including those additional and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.

WorldFlyAngler provides approved dealers with an online e-commerce platform that allows us to sell our products and services to you in accordance with the Austria E-Commerce Act §5 and Media Act §25. 

Order & Payment Policy

Order Status: To view the status of any order or to view open, past or pending Orders, please visit the My Account section of the WorldFlyAngler Dealer website. Find your order status by selecting „Order” and you will see a column titled “Order Status“.

Order Processing: All Orders shipped with Ground Shipping (Monday through Friday) typically ship out within 2 business days after  payment has been received.  Orders will be processed and shipped from our Headquarters. Your packages are insured and are shipped in standard delivery time, depending on your national residence. If the order is confirmed as delivered it is no longer the property or responsibility of WFA.

Payment Processing: All Orders are Pro Forma / Delivery upon receiving funds unless your Sales Rep has communicated

Different Terms

Definition: A “pro forma invoice” is a “confirmed purchase order” where buyer and supplier agree on detail and cost of the product to be shipped to the buyer. A pro forma invoice is generally raised when the seller is ready for dispatching the material but they want to ensure that the payment is being sent before dispatch.

At the time an ORDER is placed, your INVOICE will be authorized for the total purchase amount, including tax (In EU “VAT exempt intracommunity delivery”- Outside EU “VAT exempt export delivery according to § 6 Austrian Value Added Tax Act”) and shipping cost. Once an order has been submitted, additional items cannot be added to the order. 

RETURNS & EXCHANGES Policy

Returns: You have the right to withdraw from this contract within fourteen days without giving a reason. If 14 days have gone by since your purchase, unfortunately we can’t offer you a refund or exchange. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging. Several types of goods are exempt from being returned. Perishable goods such as sticker, gifts, books or magazines cannot be returned. To complete your return, we require a receipt or proof of purchase. Please do not send your purchase back to the manufacturer.

Shipping: We will not be responsible for paying shipping costs for returning your item, if the item is eligible for return according to the above mentioned rules for returns. Depending on where you live, the time it may take for your exchanged product to reach you, may vary. Refunds: Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund. If you are approved, then your refund will be processed, and a credit will automatically be applied to an invoice-credits on your next order. If you haven’t received a refund yet, first check your email account (spam) or contact us. 

Sale items: Only regular priced items may be refunded, unfortunately sale items cannot be refunded.

Exchanges: We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email and send your item back to us.

We stand behind our products for the expected lifetime of materials and craftsmanship. This will vary based on use and product style. Different manufactures have different rules of warranty. Data protection declaration

Thank you for your interest in our company. Data protection is of particular importance to the management of WorldFlyAngler – Matthew Calderaro. The use of our website is generally possible without the disclosure of any personal data. However, if you wish to make use of a special service provided by our company via our website, such as registration for the newsletter or use of the contact form, it may be necessary to process personal data. If the processing of personal data is required, we generally obtain the consent of the data subject.

The processing of personal data, such as the name, address, email address or telephone number of the data subject, is always carried out in accordance with the General Data Protection Ordinance (GDPR) and in accordance with the country-specific data protection regulations applicable to us.

WorldFlyAngler has implemented numerous technical and organizational measures to ensure the most complete protection of personal data processed via this website. Nevertheless, internet-based data transmissions can have security gaps so that absolute protection cannot be guaranteed. For this reason, each data subject is free to transmit personal data to us by alternative means, for example by telephone.

1. Definitions

Our data protection declaration is based on the terms used by the European directive and regulatory authority when adopting the GDPR. Our data protection declaration should be comprehensible and understandable. To ensure this, we would like to explain the terms used in advance.

a)  Personal data

Personal data means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

b)  Data subject

Data subject is any identified or identifiable natural person whose personal data is processed by the controller.

c)  Processing

Processing means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

d)  Restriction of processing

Restriction of processing means the marking of stored personal data with the aim of limiting their processing in the future.

e)  Profiling

Profiling means any form of automated processing of personal data consisting of the use of personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

f)  Pseudonymisation

Pseudonymisation means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.

g)  Controller

Controller means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.

h)  Processor

Processor means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

i)  Third party

Third party means a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data.

j)  Recipient

1. Recipient means a natural or legal person, public authority, agency or another body, to which the personal data are disclosed, whether a third party or not. 2. However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients; the processing of those data by those public authorities shall be in compliance with the applicable data protection rules according to the purposes of the processing.

k)  Consent

Consent of the data subject means any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

3.Cookies

The website of WorldFlyAngler uses cookies. Cookies are text files that are stored on a computer system via an internet browser.

This automatically provides us with certain data, such as IP addresses, browsers, operating system via your access device and your connection to the internet.

By using cookies, WorldFlyAngler can provide users of this website with more user-friendly services. For example, to facilitate navigation and enable the correct display of the website, which would not be possible without the use of cookies.

4. Collecting general data and information

The website of WorldFlyAngler collects a range of general data and information each time a data subject or an automated system accesses the website. This general data and information is stored in the log files of the server. The following data can be collected:

  • the operating system used by the accessing system
  • the website from which an accessing system reaches our website (so-called referrer)
  • the subwebsites which are accessed via an accessing system on our website
  • the date and time of access to the website
  • an internet protocol address (IP address)
  • the internet service provider of the accessing system
  • other similar data and information used for security purposes in the event of attacks on our information technology systems.

When using this general data and information WorldFlyAngler does not draw conclusions about the data subject. The anonymous data of the server log files are stored separately from all personal data provided by a data subject.

WorldFlyAngler uses the data for statistical evaluations with the aim of increasing data protection and data security in our company. In addition, the data are used to ensure the operation, security and optimisation of the offer and to provide law enforcement agencies with the information necessary for law enforcement in the event of a cyberattack.

5. Contact via the website

The website of WorldFlyAngler enables quick electronic contact to be made via a contact form or email. If you take advantage of these offers, your transmitted personal data will be stored automatically. The personal data transmitted by you to WorldFlyAngler on a voluntary basis will be stored for the purpose of processing or establishing contact. There is no disclosure of this personal data to third parties.

6. Subscription to our newsletter

The website of WorldFlyAngler gives users the opportunity to subscribe to our company’s newsletter. WorldFlyAngler informs its customers and business partners about company offers at regular intervals by means of a newsletter. Subscribers to the newsletter may also be contacted by email if this is necessary for the operation of the newsletter service or registration, as could be the case in the event of changes to the newsletter offer or technical changes.

Which personal data are transmitted to the data controller when the newsletter is ordered is determined by the input mask used for this purpose. Our company newsletter can only be received by the data subject if the data subject has a valid email address and the data subject registers to receive the newsletter. For legal reasons, a confirmation email using the double opt-in procedure is sent to the email address entered by the data subject the first time in order to the newsletter to be sent. This confirmation email serves to verify whether the owner of the email address has authorised the receipt of the newsletter as the data subject.

When registering for the newsletter, we also save the date and time of registration. The collection of this data is necessary in order to be able to trace the (possible) misuse of the email address of a data subject at a later point in time and therefore serves as legal safeguard for the data controller.

The personal data collected when registering for the newsletter will be used exclusively for sending our newsletter. Personal data will not be passed on to third parties. The subscription to our newsletter can be cancelled by the data subject at any time. The consent to the storage of personal data, which the data subject has given us for sending the newsletter, can be revoked at any time. In order to revoke your consent, you will find a corresponding link in every newsletter. It is also possible to unsubscribe directly from the newsletter on the website of the controller at any time or to inform the controller in other ways.

7. Newsletter tracking

The newsletters of WorldFlyAngler contain so-called tracking pixels. A tracking pixel is a miniature graphic that is embedded emails that are sent in HTML format to enable the log file to be recorded and analysed. This allows a statistical evaluation of the success or failure of online marketing campaigns. Based on the embedded tracking pixel, WorldFlyAngler can recognise if and when an email was opened by a data subject and which links in the email were accessed by the data subject.

Personal data collected via the tracking pixels contained in the newsletters are stored and evaluated by the controller in order to optimise the delivery of the newsletter and to better adapt the content of future newsletters to the interests of the data subject. This personal data will not be disclosed to third parties. Data subjects are entitled to withdraw the declaration of consent given separately via the double-opt-in procedure at any time. After revoking consent, this personal data will be deleted by the controller. WorldFlyAngler automatically interprets the cancellation of the receipt of the newsletter as a revocation.

8. Rights of the data subject

The introduction of GDPR gives the data subject extensive rights, which we would like to clarify in the following.

If you, as the data subject, claim this right, you can contact an employee of WorldFlyAngler at any time.

a)  Right to confirmation

The data subject shall have the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed.

b)  Right of access to information

Any person affected by the processing of personal data has the right to receive information from WorldFlyAngler free of charge at any time about the personal data stored about him or her and a copy of this information. Furthermore, the data subject has extensive information rights over:

  • the purposes of the processing;
  • the categories of personal data being processed;
  • the recipients or categories of recipient to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations;
  • where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period;
  • the existence of the right to request from the controller rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing;
  • the right to lodge a complaint with a supervisory authority;
  • where the personal data are not collected from the data subject, any available information as to their source;

;the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) GDPR and, at least in those cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject.

In addition, the data subject has a right of access as to whether or not personal data has been transmitted to a third country or to an international organisation. If that is the case, the data subject has the right to obtain information about the appropriate guarantees in connection with the transfer.

c)  Right to rectification

1. The data subject shall have the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her. 2. Taking into account the purposes of the processing, the data subject shall have the right to have incomplete personal data completed, including by means of providing a supplementary statement.

d)  Right to erasure (‘right to be forgotten’)

The data subject shall have the right to obtain from the controller the erasure of personal data concerning him or her without undue delay and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies:

  • the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;
  • the data subject withdraws consent on which the processing is based according to point (a) of Article 6(1) GDPR, or point (a) of Article 9(2) GDPR, and where there is no other legal ground for the processing;
  • the data subject objects to the processing pursuant to Article 21(1) GDPR and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) GDPR;
  • the personal data have been unlawfully processed;
  • the personal data have to be erased for compliance with a legal obligation in Union or Member State law to which the controller is subject;
  • the personal data have been collected in relation to the offer of information society services referred to in GDPR Article 8(1).

Insofar as one of the above reasons applies and a data subject has initiated the deletion of personal data stored at WorldFlyAngler and has contacted an employee of the controller, the employees of WorldFlyAngler will arrange for the deletion request to be fulfilled immediately.

If the personal data has been made public by WorldFlyAngler and if our company is obliged pursuant to Art. 17 (1) GDPR to erase the personal data, WorldFlyAngler, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures to inform other data controllers which are processing the personal data that the data subject has requested the erasure by such controllers of any links to, or copy or replication of, those personal data, as far as the processing is not necessary. The employee of WorldFlyAngler will do what is necessary to arrange this in individual cases.

e)  Right to restriction of processing

The data subject shall have the right to obtain from the controller restriction of processing where one of the following applies:

  • the accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data;
  • the processing is unlawful and the data subject opposes the erasure of the personal data and requests the restriction of their use instead;
  • the controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise or defence of legal claims;
  • the data subject has objected to processing pursuant to Article 21(1) GDPR pending the verification whether the legitimate grounds of the controller override those of the data subject.

If one of the above conditions is met and a data subject has requested the restriction of personal data stored by WorldFlyAngler and has contacted an employee of the controller, the employee will arrange to restrict the processing.

f)  Right to data portability

The data subject shall have the right to receive the personal data concerning him or her, which he or she has provided to a controller, in a structured, commonly used and machine-readable format and have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, where:

(a) the processing is based on consent pursuant to point (a) of Article 6(1) GDPR or point (a) of Article 9(2) GDPR or on a contract pursuant to point (b) of Article 6(1) GDPR and

(b) the processing is carried out by automated means.

In exercising his or her right to data portability pursuant to Article 20 (1) GDPR, the data subject shall have the right to have the personal data transmitted directly from one controller to another, where technically feasible.

The exercise of the right referred to in paragraph 1 of this Article shall not apply to processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

g)  Right to object

The data subject shall have the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her which is based on point (e) or (f) of Article 6(1) GDPR, including profiling based on those provisions. WorldFlyAngler shall no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims.

Where WorldFlyAngler processes personal data for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning him or her for such marketing, which includes profiling to the extent that it is related to such direct marketing. Where the data subject objects to processing by WorldFlyAngler for direct marketing purposes, the personal data shall no longer be processed for such purposes.

In the context of the use of information society services, and notwithstanding Directive 2002/58/EC, the data subject may exercise his or her right to object by automated means using technical specifications.

h)  Automated individual decision-making, including profiling

The data subject shall have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her.

Paragraph 1 shall not apply if the decision (a) is necessary for entering into, or performance of, a contract between the data subject and the data controller, (b) or is authorised by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, (c) or is based on the data subject’s explicit consent.

In the cases referred to in points (a) and (c) in paragraph 2 of this Article, WorldFlyAngler shall implement suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express his or her point of view and to contest the decision.

i) Right to revoke a data protection consent

Any data subject affected by the processing of personal data is entitled to revoke consent to the processing of personal data at any time.

9. Privacy policy for the use and application of YouTube

The controller has integrated components from Youtube on this website. The operator is YouTube LLC with headquarters in 901 Cherry Avenue, San Bruno, CA 94066, USA. The person responsible for the processing of personal data if a data subject lives outside the US or Canada is …

We use among others the provider YouTube for the integration of videos.

The plugins are marked with a Youtube logo. When you access the pages on our website that are provided with such a plugin – for example, from our media library – a connection to the YouTube servers is established and the plugin is displayed. This transmits which of our web pages you have visited to the YouTube server.

If you are logged in as a YouTube member, YouTube assigns this information to your personal user account. When using the plugin, e.g. clicking the start button of a video, this information is also assigned to your user account.

You can prevent this assignment by logging out of your YouTube account and other user accounts of YouTube LLC and Google Inc. and deleting the corresponding cookies of the companies before using our website.

10. Privacy policy for use and application of Vimeo

Our website includes plugins of the video portal Vimeo of Vimeo, LLC, 555 West 18th Street, New York, New York 10011, USA. When you access a page of our website that contains such a plugin, your browser establishes a direct connection to Vimeo’s servers. The content of the plugin is transmitted by Vimeo directly to your browser and integrated into the page. This integration informs Vimeo that your browser has called up the corresponding page of our website, even if you do not have a Vimeo account or are not currently logged in to Vimeo. This information (including your IP address) is transmitted directly from your browser to a Vimeo server in the USA and stored there. The data processing operations described are carried out in accordance with Article 6, paragraph 1 point (f) GDPR on the basis of Vimeo’s legitimate interest in market research and the needs-based design of the service.

If you do not want Vimeo to associate the information collected through our website directly with your Vimeo account, you must log out of Vimeo before visiting our website.

The tracking tool Google Analytics is automatically integrated in videos from Vimeo that are integrated on our site. This is Vimeo’s own tracking system, to which we have no access and which cannot be influenced by our site. Google Analytics uses cookies, which are text files placed on your computer, to help the website analyse how users use the site. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there.

This processing is carried out in accordance with Article 6, paragraph 1 point (f) GDPR on the basis of Vimeo’s legitimate interest in statistical analysis of user behaviour for optimisation and marketing purposes.

11. Privacy policy for the use and application of Google Analytics

On the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer in line with Article 6, paragraph 1 point (f) GDPR, we utilise Google Analytics, a web analysis service of Google LLC (Google). Google uses cookies. The information generated by the cookie about the use of the online offer by users is generally transferred to a Google server in the USA and stored there.

Google is certified under the Privacy Shield Agreement and thus offers a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google uses this information on our behalf to evaluate the use of our online offer by users, to compile reports on the activities in relation to this online offer and to provide us with further services associated with the use of this online offer and the use of the internet. Pseudonymous user profiles can be created from the processed data.

We only use Google Analytics with activated IP anonymisation. This means that the IP address of the users is shortened by Google within Member States of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases is the full IP address sent to a Google server in the US and shortened there.

The IP address transmitted by the user’s browser is not merged with other Google data. You can also prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Google by downloading and installing the browser plug-in available under the following link: https://tools.google.com/dlpage/gaoptout?hl=en.

Opt-out cookies prevent the future collection of your data when you visit this website. To prevent Universal Analytics from collecting data across different devices, you must opt-out on all systems used.

12. Privacy policy for use and application of Google Maps

WorldFlyAngler uses Google Maps API to display geographical information visually. When using Google Maps, Google Inc., 1600 Amphitheatre Parkway, Mountain View, California, 94043 also collects, processes and uses data about the use of the map functions by visitors to the websites.

More detailed information about data processing by Google can be found in Google’s privacy policy. The settings can also be changed there in the Data Protection Centre at www.google.com/privacypolicy.html so that the data subject can manage and protect his or her data.

13. Legal basis of processing

Article 6 I point (a) GDPR serves our company as a legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, as is the case for example with processing operations necessary for the delivery of goods or the provision of any other services or consideration, the processing is based on Article 6 I point (b) GDPR.
